1. Acceptance of Terms

By accessing and using the OXSTR website (https://oxstr.com) and/or purchasing our services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms & Conditions govern your use of our website and the purchase of our web design and development services. By submitting a purchase form and proceeding to payment, you acknowledge that you have read, understood, and agree to be bound by these terms.

2. Service Description

OXSTR provides custom website design and development services, including but not limited to:

Service Packages

• Starter Package ($899): One-page custom website with responsive design, SEO optimization, and basic interactive elements
• Business Package ($1,149): Up to 5 custom pages with advanced features, contact forms, and comprehensive SEO optimization
• Premium Package ($1,499): Complete solution with blog functionality, advanced animations, dynamic features, and enhanced SEO suite

Additional Services

• Professional Hosting Setup ($149): One-time domain configuration, SSL setup, server optimization, and analytics integration
• Ongoing Maintenance & Support ($39/month): Monthly updates, security monitoring, backups, and priority support

All websites are custom-coded using HTML, CSS, and JavaScript without reliance on templates or page builders. Upon completion and full payment, you receive complete ownership of all source files.

3. Payment Terms

Payment Processing

All payments are processed securely through Stripe, our third-party payment processor. We do not store your payment information on our servers. By making a purchase, you agree to Stripe's terms of service and privacy policy.

Payment Schedule

• Split Payment: A 50% deposit is required upfront before any design or development work begins. The remaining 50% is due upon project completion, before final delivery or deployment.
• No Hidden Fees: The price you see is the price you pay - no additional charges unless explicitly agreed upon
• Currency: All prices are listed in USD

Additional Charges

Additional fees may apply for:

• Revision rounds beyond those included in your package ($150 per additional round)
• Scope changes or feature additions not originally specified
• Expedited delivery requests
• Additional services not included in your original package

4. Project Scope and Deliverables

Included in All Packages

• Custom HTML, CSS, and JavaScript development
• Fully responsive, mobile-first design
• Cross-browser compatibility testing
• SEO-ready structure with proper meta tags
• Performance optimization
• Complete source file delivery
• Basic deployment documentation

Not Included

• Domain registration or renewal
• Web hosting services (unless Professional Hosting Setup is purchased)
• Content creation or copywriting
• Logo design or branding services
• Stock photography or custom illustrations
• E-commerce functionality or payment processing integration
• Third-party service integrations (unless specified in package)
• Ongoing maintenance (unless separately purchased)

Revision Policy

Each package includes a specific number of revision rounds:

• Starter Package: 1 revision round
• Business Package: 2 revision rounds
• Premium Package: 3 revision rounds

A revision round is defined as one comprehensive set of change requests submitted at one time. Additional revision rounds are available for $150 each.

5. Project Timeline and Delivery

Estimated Timeline

Standard project completion is estimated at 1-2 weeks from the later of:

• Confirmation of the 50% deposit payment, and
• Receipt of all required client materials and content

Timeline Dependencies

Project timeline may be extended due to:

• Delays in client feedback or approval
• Late delivery of required content or materials
• Requested changes beyond the original scope
• Additional revision rounds
• Unforeseen technical complexities

Delivery Method

Upon project completion, you will receive:

• All website source files (HTML, CSS, JavaScript, images)
• Documentation and deployment instructions
• Basic technical support for deployment questions

6. Client Responsibilities

To ensure successful project completion, clients are responsible for:

Content and Materials

• Providing all text content in digital format
• Supplying high-quality images and graphics
• Ensuring all content is legally owned or properly licensed
• Reviewing and approving content for accuracy

Communication and Feedback

• Responding to requests for feedback within 3 business days
• Providing clear, specific feedback during revision rounds
• Designating a single point of contact for project communication
• Informing us promptly of any changes in project requirements

Technical Requirements

• Providing access to hosting accounts if deployment assistance is needed
• Ensuring domain ownership and DNS control
• Testing the completed website on your preferred devices and browsers

7. Intellectual Property Rights

Client Ownership

Upon receipt of full payment, you will own:

• All custom website code and files
• The completed website design
• All custom graphics created specifically for your project

OXSTR Rights

OXSTR retains the right to:

• Display the completed work in portfolios and marketing materials
• Use the project as a case study (unless client requests otherwise)
• Reference the client as a satisfied customer
• Use general techniques and approaches developed during the project for future work

Third-Party Assets

Any third-party assets (fonts, stock photos, plugins, etc.) remain subject to their original licenses. Clients are responsible for ensuring compliance with third-party licensing terms.

8. Warranties and Disclaimers

Our Warranties

We warrant that:

• The website will be developed using professional standards and best practices
• The code will be clean, well-structured, and documented
• The website will function as described in your selected package
• We have the right to provide the services described

Disclaimer of Other Warranties

Except as expressly stated, we provide our services "as is" without any warranties, express or implied. We specifically disclaim warranties of:

• Specific business results or outcomes
• Search engine rankings or traffic levels
• Compatibility with all future browser updates
• Uninterrupted operation or error-free performance

9. Limitation of Liability

Liability Cap

Our total liability to you for any and all claims arising from or related to our services shall not exceed the total amount paid by you for the specific service in question.

Excluded Damages

In no event shall OXSTR be liable for:

• Loss of profits, revenue, or business opportunities
• Indirect, incidental, special, or consequential damages
• Data loss or corruption
• Business interruption or downtime
• Third-party claims or actions
• Damages arising from client's use or misuse of the delivered website

10. Termination

Termination by Client

You may terminate the project at any time by providing written notice. In the event of termination:

• You will receive any completed work up to the termination date
• Payment is non-refundable (see our Refund Policy for exceptions)
• You remain responsible for payment of any additional services already provided

Termination by OXSTR

We reserve the right to terminate the project under the following circumstances:

• The Client fails to provide required materials or feedback for 30 or more consecutive days
• The Client fails to submit the remaining 50% payment within 7 days after project completion
• The Client violates any of the terms outlined in this agreement
• he project scope changes significantly from the originally agreed-upon terms
• The Client engages in abusive, disrespectful, or inappropriate behavior toward any member of our team

11. Website Use and Restrictions

Acceptable Use

Our services may not be used for websites that:

• Violate any applicable laws or regulations
• Promote illegal activities or products
• Contain adult content, gambling, or related services
• Infringe on third-party intellectual property rights
• Contain hate speech, discriminatory content, or harmful material
• Distribute malware or engage in fraudulent activities

Content Responsibility

You are solely responsible for all content on your website and must ensure it complies with applicable laws and regulations. We reserve the right to refuse service for any project we deem inappropriate.

12. Support and Maintenance

Included Support

All packages include:

• 30 days of basic technical support after delivery
• Bug fixes for issues present at delivery
• Deployment guidance and documentation

Additional Support

For ongoing support beyond the initial 30 days, consider our Ongoing Maintenance & Support service ($39/month), which includes:

• Priority email support
• Regular backups and security monitoring
• Content updates and minor modifications
• Performance optimization

13. Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or government actions.

14. Governing Law and Disputes

Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these terms or our services shall be resolved through:

1. Good faith negotiation between the parties
2. Mediation, if negotiation fails
3. Binding arbitration in Washington State, if mediation fails

15. Changes to Terms

We reserve the right to modify these Terms & Conditions at any time. Changes will be effective immediately upon posting to our website. We will notify existing clients of material changes via email. Your continued use of our services after any changes constitutes acceptance of the new terms.

16. Severability

If any provision of these Terms & Conditions is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.

17. Entire Agreement

These Terms & Conditions, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and OXSTR regarding our services. These terms supersede all prior communications, proposals, or agreements between the parties.
